1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” “Client,” “Consignor”) and Sale Advisor (“we,” “us,” “our,” “Company”), a consignment sales company based in Chicago, Illinois. By using our website at saleadvisor.com (the “Site”) or engaging our services in any way, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.
2. Description of Services
Sale Advisor provides full-service consignment sales. Our services include:
- Free in-home consultations and item cataloging at your location
- Professional photography and detailed descriptions of consigned items
- Listing items for sale online through channels selected at our discretion to maximize exposure and sale price
- Managing buyer inquiries, negotiations, and sale transactions
- Coordinating item pickup from your home and delivery to the buyer through our delivery partner, Lakeshore Hauling LLC
- Processing payouts to you after successful sale and delivery
There is no cost to you. We earn our fee through a commission on completed sales.
3. Eligibility
To use our services, you must:
- Be at least 18 years of age
- Be the rightful owner of all items consigned with us, or be legally authorized to sell them on the owner’s behalf
- Ensure all consigned items are free of liens, encumbrances, legal claims, and any restrictions on sale
- Reside within our current service area (Chicago metropolitan area) or have items located within our service area
- Have the legal capacity to enter into this agreement
By using our services, you represent and warrant that you meet all of these eligibility requirements.
4. How It Works
- Contact Us: You reach out via text at (872) 312-SALE, through our website, or through one of our advertising channels (social media, lead forms, etc.).
- Free Consultation: We schedule a free in-home visit where we catalog everything you want to sell, assess item condition, and discuss pricing. Commission rates are agreed upon at this stage.
- Listing: We professionally photograph your items, write descriptions, and list them for sale online.
- Sale and Delivery: When an item sells, our team coordinates pickup from your home and delivery to the buyer through Lakeshore Hauling LLC.
- Payment: You receive your payout (the sale price minus our agreed-upon commission) after successful delivery confirmation. Delivery fees are separate and paid by the buyer.
5. Commission and Fees
5.1 Commission Structure
Sale Advisor earns a commission as a percentage of each item’s final sale price. Commission rates vary by item and are agreed upon between you and Sale Advisor during the in-home consultation, before any items are listed. No items will be listed without your agreement on commission rates.
5.2 Delivery Fees
Delivery fees are separate from and in addition to our commission. Delivery fees are paid by the buyer and are not deducted from your payout. Delivery is handled exclusively by our partner, Lakeshore Hauling LLC.
5.3 No Costs
You pay nothing upfront. There are no listing fees, photography fees, or service charges. Our commission is only earned when an item successfully sells.
5.4 Payout Timing
Payouts are issued after the item has been delivered to the buyer and delivery is confirmed. Payout method and timing are agreed upon during the onboarding process.
6. Your Responsibilities as a Consignor
By consigning items with Sale Advisor, you agree to:
- Ownership: All items consigned are yours to sell and are free of liens, legal claims, recalls, or restrictions.
- Accurate descriptions: You will provide honest and accurate information about each item’s condition, history, and any known defects or damage.
- Access: You will make items accessible for photography, listing, and pickup at your home at agreed-upon times.
- Communication: You will respond to our messages in a timely manner regarding scheduling, pricing decisions, and sale confirmations.
- Item care: You will keep consigned items in the same condition as when cataloged, until they are picked up for delivery.
- Minimum pricing: You will set minimum acceptable prices during the consultation. We will not sell below your approved minimum without your consent.
- Legal compliance: You will not consign stolen, counterfeit, illegal, hazardous, or recalled items.
7. Listings and Intellectual Property
7.1 Listing Content
When you consign items with us, you grant Sale Advisor a non-exclusive, royalty-free license to photograph your items, create written descriptions, and publish this content across any online channel or marketing platform we use to sell the item, including social media and our own website.
7.2 Item Photos
Photographs taken by Sale Advisor during the cataloging process are owned by Sale Advisor. We may use these photos in online listings, advertising, social media, and marketing materials. Photos will not include identifiable personal information such as your face, address signage, or personal documents.
7.3 Sale Advisor Content
All content on saleadvisor.com, including text, images, logos, graphics, design elements, and software, is the property of Sale Advisor and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from our content without our prior written permission.
8. Unsold Items
If an item does not sell within the agreed consignment period, you have the following options:
- Lower the minimum asking price to increase the chance of sale
- Extend the listing period
- Remove the item from consignment (the item remains in your home)
You owe nothing for unsold items. There is no penalty or fee for items that do not sell.
9. Cancellations and Withdrawals
9.1 Before Sale
You may withdraw an item from consignment at any time before a sale is confirmed. Simply contact us and we will remove the listing.
9.2 After Sale Confirmation
Once a sale is confirmed and delivery is scheduled, cancellation may not be possible. If an item has already been picked up for delivery, a return logistics fee may apply.
9.3 Buyer Cancellations
If a buyer cancels after a sale is confirmed, we will re-list the item at no additional cost to you. If the item has already been picked up, we will coordinate its return to you.
10. Delivery Terms
All delivery is handled exclusively by our partner, Lakeshore Hauling LLC.
- Delivery is coordinated between the buyer, Sale Advisor, and Lakeshore Hauling after a sale is confirmed.
- Delivery fees are determined based on item size, weight, and distance, and are paid by the buyer.
- We make reasonable efforts to complete delivery within the agreed timeframe, but exact timing may vary due to scheduling, weather, or other factors.
- Items are handled with care during pickup and delivery. We are not a storage service. Items remain in your home until a sale is confirmed and delivery is scheduled.
11. Liability and Disclaimers
11.1 Item Handling
Sale Advisor and Lakeshore Hauling LLC take reasonable care when handling your items during cataloging, photography, pickup, and delivery. However, we are not liable for:
- Normal wear and tear during the consignment period while items remain in your home
- Damage or defects that existed prior to consignment or that were not disclosed by you
- Market value fluctuations that affect the final sale price
- Items that fail to sell within any particular timeframe
- Loss or damage caused by circumstances beyond our reasonable control, including but not limited to weather events, traffic accidents, acts of God, or government actions
For items damaged during pickup or delivery due to our negligence, we will work with you to reach a fair resolution on a case-by-case basis.
11.2 Service Availability
We strive to provide uninterrupted service but do not guarantee that our Site, communication channels, or online listings will be available at all times. We are not liable for temporary service disruptions caused by maintenance, technical issues, or third-party platform outages.
11.3 Disclaimer of Warranties
Our services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that any particular item will sell, sell for a specific price, or sell within any particular time period.
12. Limitation of Liability
To the maximum extent permitted by law, Sale Advisor’s total aggregate liability for any claim or series of claims arising from or related to our services shall not exceed the total commission earned by Sale Advisor on the specific transaction(s) in question.
In no event shall Sale Advisor be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, regardless of whether we have been advised of the possibility of such damages.
13. Indemnification
You agree to indemnify, defend, and hold harmless Sale Advisor, its owners, employees, agents, and partners (including Lakeshore Hauling LLC) from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to:
- Your breach of these Terms
- Your consignment of items you do not have the right to sell
- Inaccurate or misleading information you provide about consigned items
- Any claims by third parties related to items you consigned
- Your violation of any applicable law or regulation
14. SMS Communications
By providing your phone number through any channel (text message, website form, lead form, or in person), you consent to receive service-related text messages from Sale Advisor at (872) 312-SALE. These messages relate to scheduling, item updates, sale confirmations, and payout notifications. They are not marketing messages.
- Opt out: Text STOP to (872) 312-SALE at any time to stop receiving messages.
- Help: Text HELP for assistance.
- Frequency: Message frequency varies based on your service activity.
- Rates: Message and data rates may apply depending on your carrier and plan.
- Privacy: Your phone number and message content will never be shared with or sold to third parties for marketing purposes.
15. Website Use
When using our Site, you agree not to:
- Submit false, misleading, or fraudulent information through any form
- Attempt to gain unauthorized access to our systems, databases, or administrative areas
- Use automated tools (bots, scrapers, crawlers) to access or extract data from our Site without our written permission
- Interfere with or disrupt the operation of our Site or servers
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Use our Site for any purpose that is illegal or prohibited by these Terms
We reserve the right to block access, remove content, or terminate service to anyone who violates these Terms.
16. Third-Party Platforms and Services
Our services involve interaction with third-party platforms and services, including but not limited to advertising platforms (Meta, TikTok, Google) and online sales channels. Your use of those platforms is governed by their respective terms of service and privacy policies. Sale Advisor is not responsible for the practices, content, or availability of third-party platforms.
When items are listed on third-party platforms, those listings are subject to the rules and policies of each platform. We are not responsible for actions taken by those platforms, including listing removal, account restrictions, or policy changes.
17. Dispute Resolution
17.1 Informal Resolution
We are committed to resolving disputes fairly and efficiently. If you have a concern or complaint, please contact us first at loganbronstein@saleadvisor.com or text (872) 312-SALE. We will make a good-faith effort to resolve the matter informally within 30 days.
17.2 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
17.3 Jurisdiction
Any disputes that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Cook County, Illinois. You consent to the personal jurisdiction and venue of these courts.
17.4 Class Action Waiver
To the extent permitted by law, you agree that any disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.
18. Termination
18.1 Your Right to Terminate
You may stop using our services at any time by contacting us and withdrawing any unsold items from consignment. Any items with confirmed sales and scheduled deliveries will be completed per these Terms.
18.2 Our Right to Terminate
We reserve the right to refuse or discontinue service to any individual at our discretion, including but not limited to situations involving fraud, misrepresentation, abusive behavior, consignment of prohibited items, or violation of these Terms. We will make reasonable efforts to notify you and resolve any pending transactions.
18.3 Effect of Termination
Upon termination, any pending payouts for completed sales will still be issued. Sections of these Terms that by their nature should survive termination (including liability, indemnification, intellectual property, and dispute resolution) will remain in effect.
19. Prohibited Items
You may not consign the following types of items with Sale Advisor:
- Stolen property or items involved in legal disputes
- Counterfeit, replica, or knockoff goods represented as authentic
- Hazardous materials, weapons, firearms, ammunition, or explosives
- Recalled products
- Items that are illegal to sell under federal, state, or local law
- Drugs, drug paraphernalia, or controlled substances
- Perishable items (food, plants, live animals)
- Items with active liens or encumbrances
We reserve the right to refuse any item at our discretion during the in-home consultation or at any point during the consignment process.
20. Force Majeure
Sale Advisor shall not be liable for any delay or failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government orders, labor disputes, utility failures, cyberattacks, or third-party platform outages.
21. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed. The remaining provisions shall continue in full force and effect.
22. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sale Advisor regarding your use of our Site and services. These Terms supersede any prior agreements or communications, whether written or oral, regarding the subject matter of these Terms.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, practices, or legal requirements. When we make changes, we will update the “Last updated” date at the top of this page. For material changes, we may also notify you via SMS or email. Your continued use of our Site or services after changes are posted constitutes your acceptance of the updated Terms.
